DEAR CLIENT,

We care about your privacy, we protect your personal data, our activities have been adapted to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as “GDPR”)

The following persons are joint controllers of your personal data:

  1. Anna Urszula Betnarska, running a business with its registered office in Józefów, at ul. Marie Curie – Skłodowskiej 14, 05-420 Józefów,
  2. Elżbieta Dobrucka, running a business with its registered office in Józefów at ul. Marie Curie – Skłodowskiej 14, 05-420 Józefów

jointly conducting business activity in the form of a civil partnership under the name “Elandom Nieruchomości S.C. E. Dobrucka A. Betnarska” with its registered office in Józefów, at ul. Marie Curie – Skłodowskiej 14, 05-420 Józefów, with the Tax Identification Number: 532 205 53 63 and the REGON number: 363029465.

In fulfillment of their obligation under Article 26 of the GDPR, the Joint Controllers have entered into an agreement to jointly control your personal data, pursuant to which they are jointly responsible for fulfilling their obligations under the GDPR, in particular with respect to the exercise of your rights and obligations to provide the information referred to in Articles 13 and 14 of the GDPR. In accordance with the provisions of this agreement and the GDPR, you may exercise your rights under the GDPR with respect to each of the Joint Controllers.

WHAT PERSONAL DATA DO WE PROCESS?

  • We process personal data that you have provided to us: a) in the content of the contact FORM, or b) in the AGREEMENT concluded with us, or c) in a document containing your CONSENT to the processing of specific data for a specific purpose.
  • We may also process your personal data obtained from another broker or from a public space if you post it there with information that you are seeking contact with the broker. In such case, we will inform you when and from what source we obtained your personal data.

FOR WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

  • If you have submitted the WRITE TO US FORM in the Contact tab, the personal data contained therein will be processed to contact you and determine how we can help you. The legal basis for personal data processing is Article 6(1)(f) of the GDPR.
  • If you have submitted the SEARCH REPORT/OFFER REPORT FORM in the Report tab, the personal data contained therein will be processed to present our offer to you or to process your offer, in accordance with your request. The legal basis for personal data processing is Article 6(1)(b) of the GDPR.
  • If you have entered into an AGREEMENT with Us, the personal data contained therein will be processed for the purpose of performing the Agreement pursuant to Article 6 paragraph 1 letter b) of the GDPR, but also pursuant to Article 6 paragraph 1 letter c) of the GDPR in order to comply with Our legal obligations, such as the need to maintain accounting, tax or archiving documentation, and pursuant to Article 6 paragraph 1 letter f) if it is necessary to establish, pursue or defend claims related to the performance of the Agreement.
  • If you are/were OUR CUSTOMER – we may ask you to express your opinion on the quality of our services – then we process your data on the basis of Article 6 paragraph 1 letter f) of the GDPR in order to examine and improve the quality of the services we provide.
  • If you CONSENT to this, your personal data may be processed pursuant to Article 6(1)(a) of the GDPR for marketing and promotional purposes, including those related to the offers of our Partners supporting our business activities, such as Banks or credit advisors.
  • If we initiated contact with you, this means that we obtained your data from another real estate agent or from a publicly available space where you posted information about seeking contact with a real estate agency. In such a situation, we process your data under Article 6(1)(f) of the GDPR to offer our services, which constitutes our legitimate interest.

HOW LONG DO WE STORE YOUR PERSONAL DATA?

  • If we have established contact but it has not led to the conclusion of an INTERMEDIATION AGREEMENT – your personal data provided in the Forms and/or other correspondence with us will be processed for the period necessary to handle the correspondence.
  • If we have concluded an INTERMEDIATION AGREEMENT, your personal data will be processed until the Intermediation Agreement is fulfilled or for a period equal to the limitation period for claims arising therefrom or equal to the period of storage of documentation related to the implementation of the Intermediation Agreement, in accordance with the requirements of generally applicable law – whichever is longer.
  • If we process personal data based on your CONSENT, we will process it until you withdraw your consent, which you can do at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

WHO HAS ACCESS TO YOUR PERSONAL DATA?

  • The collected data may be disclosed to entities processing personal data on behalf of the Joint Controllers, i.e. employees and cooperating Agents.
  • If we have concluded a Brokerage Agreement – We may also make your data available to entities cooperating with Us in the performance of the brokerage agreement, including notaries. The collected data may be disclosed to potential contractors interested in the property you offer or to potential contractors offering the property you will be interested in. The collected data may also be disclosed to entities supporting our business, in particular to suppliers of external IT systems and other IT tools, accounting, tax and legal service offices.
  • In some cases, your personal data may be transferred to public authorities. This will only be the case where we are required to do so by applicable law.

TRANSFER OF PERSONAL DATA TO COUNTRIES OUTSIDE THE EU

  • Due to the use of external IT systems by us, including social networks, your personal data may be processed by entities outside the European Union. An appropriate level of protection of your data, including through the application of appropriate safeguards, is ensured by the application of standard data protection clauses adopted by the European Commission, referred to in Article 46(2)(c) of the GDPR.

WHAT DO WE NOT DO WITH YOUR PERSONAL DATA?

  • Your personal data will not be subject to profiling or other automated decision-making.

WHAT ARE YOUR RIGHTS?

You have the right to:

  • Access your personal information, including obtaining a copy;
  • Rectification of personal data;
  • Delete personal data;
  • Restriction of the processing of personal data;
  • Requests to transfer personal data to another controller;

And:

  • Objection to the processing of your personal data: a) for reasons related to your particular situation – to the processing of personal data concerning you, based on Article 6(1)(f) of the GDPR, i.e. on the legitimate interests pursued by the administrator, and b) if the personal data are processed for the purposes of direct marketing, to the extent that such processing is related to such direct marketing.
  • Withdraw your CONSENT to the processing of your personal data – in relation to the processing carried out for the purposes and to the extent consistent with the Consent you have granted.
  • Filing a COMPLAINT with the supervisory authority (President of the Office for Personal Data Protection with its registered office in Warsaw at Stawki 2, 00-193 Warsaw) – in a situation where you believe that your personal data is being processed unlawfully.

SECURITY OF PERSONAL DATA

  • When processing your personal data, we use organizational and technical measures required by applicable legal regulations, including the use of SSL certificate encryption.

YOU DECIDE

  • PROVIDING PERSONAL DATA is voluntary, but in some situations it may be necessary (conclusion of a brokerage agreement) and required.
  • Depending on the PURPOSE for which the data are provided – failure to provide them may result in: inability to establish contact, inability to receive information about offers.
  • Providing the PHONE NUMBER is voluntary and serves to speed up contact by phone, but it is not required.
